Immigration Court
The Immigration Court is an administrative court within the Executive
Office of Immigration Review (EOIR). Unlike ICE, EOIR remained under
the Department of Justice after the creation of the Department of Homeland
Security. An immigration judge presides over removal hearings for ICE
detainees. The Board of Immigration Appeals (BIA) adjudicates appeals
of immigration judge decisions and certain decisions of ICE.
